General Terms and Conditions of TIMEHOUSE Betreiber GmbH & Co. KG called Timehouse
SCOPE OF APPLICATION
These GTCs apply to all guest accommodation contracts and reservations concluded between Timehouse and third parties (guests) as well as to all other services provided by Timehouse. The subletting or re-letting as well as the use for purposes other than the agreed purpose require prior written consent.
RESERVATIONS, RESALE
By accepting a reservation made by the guest, an accommodation agreement is concluded. This agreement, in the form of a reservation of the booked accommodation suites, is binding for both contracting parties. There is no entitlement to use the accommodation service in a specific suite, but in the booked category or higher. Timehouse reserves the right to rent the reserved rooms to other parties after the reservation has expired. The guest will receive a binding booking or reservation number from Timehouse and, if expressly requested, a written confirmation of the reservation. Timehouse reserves the right to define industry-standard restrictions such as minimum stays, booking guarantees or deposits for certain dates.
The resale/rental and/or subletting of booked rooms is prohibited. In particular, the subletting of rooms and/or room allotments to third parties at prices higher than the actual room prices is not permitted. The assignment or sale of the claim against Timehouse is also not permitted. In such cases, Timehouse is entitled to cancel the booking, in particular if the guest has provided false information about the type of booking or payment to the third party in the assignment/sale. Use of the hotel room for any purpose other than accommodation is expressly prohibited.
GUARANTEED RESERVATIONS AND CANCELLATION DEADLINES
In the event of a no-show, the full amount of the booked stay will be charged at 100%. In the case of more than one overnight stay, Timehouse will endeavor to re-let the suite in consultation with the guest. If this is not successful, the costs are to be borne by the guest. All booked rates with deposited special conditions such as non-cancelable rates ( Non Refundable/ Non Ref) are in no case refundable or changeable. Please pay attention to the cancellation policy on your direct reservation confirmation.
PAYMENT METHOD AND MEANS OF PAYMENT
Unless specified separately on the reservation confirmation, the price of the entire booked accommodation service must always be paid by the guest at the Timehouse, at the latest on departure. We require your credit card details as a guarantee for payment on departure.
Valid means of payment are cash in Euro, EC-Maestro card, Master Card, Visa Card and American Express. If payment is made by bank transfer, the full payment amount must be credited to our account at least one working day before arrival. Please state the reservation number and the name of the guest arriving as the reason for payment.
WARRANTY
To guarantee your reservation, we require a valid credit card number including expiration date. If no other conditions are specified in the reservation confirmation, the credit card will not be charged but will be used purely to guarantee the reservation.
TAXES AND FEES
The applicable prices are gross total prices and include all statutory taxes, fees and charges. Timehouse reserves the right to adjust the prices accordingly in the event of a change in tax, fee and levy rates as well as the effective levying of new taxes, fees and levies previously unknown to the parties.
OPTIONS FOR USING RESERVED ROOMS
Reserved suites are available to guests from 3 p.m. on the day of arrival and until 11 a.m. on the day of departure. On request and subject to availability, a later departure (late check-out) can be arranged with the hotel in advance. If the hotel agrees to a late check-out, the hotel is entitled to charge EUR 20.00 per hour or part thereof for the additional use of the room. For departures after 3 p.m., the full current daily rate for the suite will be charged. There is no contractual entitlement to a late check-out but is subject to availability and agreement on site. If the apartment is damaged, soiled or used beyond the normal extent, a corresponding repair or special cleaning will be charged to the guest at 100%.
WITHDRAWAL OF THE HOTEL
If the customer's right to withdraw from the contract within a certain period has been agreed in writing, the hotel is entitled to withdraw from the contract during this period if there are inquiries from other customers for the contractually booked rooms and the customer does not waive his right of withdrawal upon enquiry by the hotel.
If an agreed advance payment is not made on time, the hotel is also entitled to withdraw from the contract
Furthermore, the hotel is entitled to withdraw from the contract without notice for objectively justified reasons, for example if
- force majeure or other circumstances for which the hotel is not responsible make it impossible to fulfill the contract;
- rooms are booked under misleading or false statements of material facts, e.g. in the person of the customer or the purpose;
- the hotel has reasonable grounds to believe that the
use of the hotel's services may jeopardize the smooth operation of the hotel without this being attributable to the hotel's sphere of control or organization.

The customer undertakes to inform the hotel immediately without being asked, but at the latest upon conclusion of the contract, that the terms of service and/or the event, whether due to its political, religious or other character, is likely to cause public interest or affect the interests of the hotel. Newspaper advertisements, other advertising measures and publications relating to the hotel generally require the written consent of the hotel.
If the customer violates this obligation to provide information or if a publication is made without such consent, the hotel has the right to cancel the event.
In the event of justified withdrawal by the hotel, the customer shall have no claim to compensation. The statutory provisions shall apply to claims for damages by the hotel.
LIABILITY OF TIMEHOUSE
Liability is limited to damages, consequential damages or disruptions that are attributable to intent or gross negligence in areas not typical of the service, with the exception of cases under Section 309 (7). The customer is obliged to make reasonable efforts to remedy the disruption and minimize any possible damage.
The hotel is liable to the customer for items brought into the hotel in accordance with the statutory provisions. Liability claims expire if the customer does not notify the hotel immediately after becoming aware of the loss, destruction or damage (§ 703 BGB).
Messages, post and consignments for guests are handled with care. The hotel will deliver, store and - on request - forward them for a fee. Claims for damages, except for gross negligence or intent, are excluded.
PARKING
If the guest is provided with a parking space in the hotel garage, even for a fee, this does not constitute a safekeeping agreement. Timehouse is under no obligation to monitor the parking space. Timehouse is liable for all damages within the scope of the regulations mentioned in the above paragraph. The guest is obliged to report any damage immediately, in any case before leaving the parking facility. Timehouse is not liable for damage for which other tenants or other third parties are solely responsible. There is no entitlement to a fixed parking space, but is subject to the availability of the designated Timehouse parking spaces.
FOOD AND BEVERAGES
The consumption and preparation of food in your second home is permitted, as long as it does not cause unacceptable odors or disturb other guests. In the public areas, you are permitted to bring your own food and drink.
ALARM
Should a guest trigger a fire alarm due to willful misconduct, the fire department will pass the bill on to the guest on a 1:1 basis.
NO SMOKING IN THE HOTEL
The Timehouse is a non-smoking hotel. It is therefore forbidden to smoke in the public areas as well as in the guest rooms. In the event of non-compliance, Timehouse has the right to demand an amount of EUR 200.00 from the guest as compensation for the separate cleaning costs incurred, including any loss of revenue from not being able to let the room as a result. If the room cannot be rented out in the following nights due to the odor despite special cleaning, the guest must also pay the cancellation costs in the amount of the currently valid apartment price.
We are happy to provide you with ashtrays on your balconies and terraces for outdoor smoking only.
PETS
Please notify Timehouse before arrival if you wish to bring a pet with you. If Timehouse agrees to a pet being brought along, this is on condition that the pet is under the constant supervision of the guest, is free from illness and does not pose any other danger to hotel guests or hotel staff. A fee of EUR 20.00 per night will be charged for the pet.
Exceptions to this are guide dogs, deaf dogs and other comparable service dogs. These may be brought along free of charge and at any time.
Please refer to your accommodation contract for the special conditions for long-stay reservations, group reservations and event and trade fair bookings.
FINAL PROVISIONS
Amendments and additions to the contract or the General Terms and Conditions should be made in text form. Unilateral amendments or additions by the guest are invalid. The place of jurisdiction for all disputes arising between the parties from the contractual relationship is Munich, insofar as the contractual partner of Timehouse is a merchant, a legal entity under public law or a special fund under public law.
